  • Your Data: You own your input data; we own the platform and the compiled digests.
  • Liability: Our liability is strictly limited. We provide the service "AS IS."

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a binding legal agreement between you ("Subscriber," "you," or "your") and The Weekly Byte, LLC ("Company," "we," "us," or "our"), a Massachusetts limited liability company.

By registering for an account, accessing the website at theweeklybyte.com ("Site"), or using our subscription services (collectively, the "Service"), you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Definitions

  • "Digest" means the summarized news and information delivered to you via email or the Portal.
  • "Portal" means the web-based interface where Subscribers manage their account and preferences.
  • "Content" means all text, data, and information generated by the Service, including the Digests.
  • "Inputs" means the list of companies you follow and other information you provide to us.

3. Eligibility and Account Registration

3.1 Eligibility. You must be at least 18 years old to subscribe. By using the Service, you represent and warrant that you meet this requirement.

3.2 Account Security. You are responsible for maintaining the confidentiality of your login credentials. You are responsible for all activities that occur under your account. You agree to notify us immediately at support@theweeklybyte.com if you suspect unauthorized use.

4. Subscription, Billing, and Cancellation

4.1 Recurring Subscription. The Service is offered on a subscription basis ("Subscription"). By purchasing a Subscription, you authorize us (through our third-party payment processor, Stripe) to charge your payment method the applicable fee ("Subscription Fee") in advance on a recurring basis, according to the billing cycle selected by you at checkout (e.g., monthly or annually).

4.2 Auto-Renewal. Your Subscription will automatically renew at the end of each billing cycle (whether monthly or annually) unless you cancel it before the renewal date.

4.3 Cancellation. You may cancel your Subscription at any time by logging into the Portal and following the cancellation prompts or by contacting support@theweeklybyte.com.

  • Effect of Cancellation: If you cancel, your Subscription will continue until the end of your current paid billing cycle.

4.4 Refunds. All fees are non-refundable except as required by law.

4.5 Price Changes. We may change the Subscription Fee upon notice to you (e.g., via email). Price changes will take effect at the start of the next billing cycle following the notice period.

5. Important Disclaimers: AI and Information Accuracy

5.1 AI-Generated Content. The Service utilizes artificial intelligence ("AI") and software workflows to summarize third-party news. You acknowledge that AI systems can make mistakes, "hallucinate" facts, or misinterpret context. We do not guarantee the accuracy, completeness, or neutrality of the Digests.

5.2 No Professional Advice. The Service is for general informational purposes only. The Company is not a financial advisor, investment broker, or legal counsel. The Digests do not constitute investment, financial, or legal advice. You alone are responsible for any decisions you make based on the Content.

5.3 No Affiliation. Unless explicitly stated, The Weekly Byte, LLC is not affiliated with, endorsed by, or sponsored by any of the companies mentioned in the Digests.

6. Email Delivery

6.1 Deliverability. The core value of the Service is delivered via email. You are responsible for providing a valid email address and ensuring our emails are not blocked by your spam filters.

6.2 Service Communications. By using the Service, you consent to receive transactional emails (e.g., Digests, billing receipts, password resets). You may opt out of marketing emails, but you cannot opt out of essential Service emails while your account is active.

7. Intellectual Property and License

7.1 Company IP. We own all rights, title, and interest in the Service, the Portal, the underlying software, and the format of the Digests.

7.2 Limited License. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access the Service and read the Digests for your personal or internal business use.

7.3 Restrictions. You may not:

  • Resell, redistribute, or syndicate the Digests to third parties.
  • Use bots, scrapers, or spiders to access the Service.
  • Reverse engineer the Service or build a competitive product.

8. User Inputs and Data Use

8.1 Ownership. You retain ownership of your Inputs (e.g., your watchlist).

8.2 License to Company. You grant us a license to process, store, and use your Inputs to provide the Service.

8.3 Improvement of Service. You agree that we may use de-identified, aggregated usage data to analyze trends and improve our AI models and Service.

9. Third-Party Services

The Service relies on third-party vendors, including Stripe for billing and various AI providers (e.g., OpenAI, Anthropic) for content generation. We are not responsible for the availability or performance of these third-party services. Your use of such services may be subject to their respective terms and privacy policies.

10. Termination

We reserve the right to suspend or terminate your account at our sole discretion, without notice, if we believe you have violated these Terms or if your use poses a security risk. If we terminate for cause, you will not receive a refund.

11. Warranty Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, THE WEEKLY BYTE, LLC DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE DIGESTS WILL BE ERROR-FREE OR THAT THE SERVICE WILL BE UNINTERRUPTED.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE WEEKLY BYTE, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES. OUR TOTAL CUMULATIVE LIABILITY FOR ANY CLAIMS ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO US IN THE SIX (6) MONTHS PRECEDING THE CLAIM.

Some jurisdictions (including Massachusetts in certain contexts) do not allow the exclusion of certain warranties or limitations on liability. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law.

13. Indemnification

You agree to indemnify and hold harmless The Weekly Byte, LLC and its officers, directors, and employees from any claims, damages, or expenses (including legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

14. Dispute Resolution

14.1 Governing Law. These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict of laws principles.

14.2 Venue. Any legal suit, action, or proceeding arising out of these Terms shall be instituted exclusively in the federal or state courts located in Massachusetts. You waive any objection to the jurisdiction and venue of such courts.

15. General Provisions

15.1 Changes to Terms. We may modify these Terms at any time. We will provide notice of material changes (e.g., by email or a banner on the Portal). Your continued use of the Service after the effective date constitutes acceptance.

15.2 Severability. If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force.
